1. Agreement to Terms
By accessing or using Simulation OS ("the Service"), operated by Simulation OS ("we", "us", or "our") at sim-os.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.
2. Description of Service
Simulation OS is a discrete-event simulation platform for operational intelligence. The Service allows users to design, run, optimize, and analyze simulations across domains including supply chain, healthcare, trading, and more. The Service is provided as a Software-as-a-Service (SaaS) product with free and paid subscription tiers.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for safeguarding your API key and for any activity under your account.
- You must notify us immediately of any unauthorized use of your account.
- You must be at least 18 years of age to use the Service.
4. Subscription Plans and Payment
- The Service offers Free, Pro, and Premium subscription tiers with varying feature limits.
- Paid subscriptions are billed on a monthly or annual basis as selected at checkout.
- Payments are processed securely by our payment provider, Paddle (Paddle.com Market Limited), which acts as the Merchant of Record for all transactions.
- Prices are displayed in USD unless otherwise indicated and are inclusive of applicable taxes as calculated by Paddle.
- You agree to pay all fees associated with your selected plan. Failure to pay may result in suspension of your account.
5. Free Trial
We may offer a free trial period for paid plans. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You will be notified before any charges are applied.
6. Cancellation and Refunds
- You may cancel your subscription at any time from the Billing page or by contacting support.
- Upon cancellation, your subscription remains active until the end of the current billing period.
- Refunds are handled in accordance with our Refund Policy.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to transmit malicious code, viruses, or harmful data.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Resell, sublicense, or redistribute the Service without our prior written consent.
- Exceed the usage limits of your subscription plan through automated or abusive means.
8. Intellectual Property
- The Service, including its design, code, features, and documentation, is the intellectual property of Simulation OS and is protected by applicable copyright, trademark, and other intellectual property laws.
- You retain ownership of any simulation configurations, data, and results you create using the Service ("User Content").
- You grant us a limited license to process and store your User Content solely to provide the Service to you.

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
10. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
- We may perform maintenance, updates, or changes that temporarily affect availability.
- We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.
11. Limitation of Liability
To the maximum extent permitted by law, Simulation OS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amounts paid by you in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Simulation results are for informational purposes and should not be the sole basis for business decisions.
13. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service ceases immediately.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
